A Guide to help you Navigate if you are subjected to Absconding in the UAE
If you have been absent from work for seven consecutive days without a valid reason or informing your employer, you may face an absconding case in accordance with Article 6 of Ministerial Resolution No. 47 of 2022. This law allows employers to file an Unexpected Work Abandonment (UWA) report, commonly known as an absconding report, if they are unable to contact the worker or are unaware of their whereabouts.

How to check in MOHRE
Select Absconding Withdraw Cancellation Document.
Enter your Transaction number.
Then you’ll get the status of the Absconding Withdraw Cancellation Document.
If you possess a labor card, you can verify with the Ministry of Human Resources and Emiratisation (MOHRE) whether an absconding case has been registered against you. Additionally, as long as you have a valid UAE residence visa, you may contact the immigration department in your Emirate for assistance.

How to Remove name from Absconding Case?
If you are facing an absconding case in the UAE, you must first address any unresolved matters with your previous employer and obtain a No Objection Certificate (NOC) from them. Following this, you must present the NOC to the Ministry of Human Resources and Emiratization (MOHRE) for evaluation and a final decision.
Is there any chance for us to visit UAE Again?

Is there any way to clear my name from Absconding List?
Once your case is settled, you can obtain NOC from your employer and present it to MOHRE. Your name will be cleared.

Can I stay in the UAE after an absconding case is filed against them?
If an employee has a valid visa in the UAE, they are permitted to remain in the country. However, if an absconding case has been filed against them, they should report to the Ministry of Human Resources and Emiratisation (MOHRE) and/or the immigration department to request the removal of the absconding case.
Can I get another job while the case is still active?
If an absconding case is in effect, transactions such as issuing work permits or residency visas in the labor or immigration department are put on hold until the case is resolved and removed.
Can my new employer apply for a Work Visa if I have Case?
If there is an active absconding case against you, your potential new employer will not be able to apply for a work permit or visa for you, even if you have found a job opening. In accordance with UAE Labour Law, if a UWA report is filed against you and the case is not cancelled, you may face a one-year labor ban.
What to do if the absconding case is wrongly filed against me?
You can ask for the absconding report to be cancelled if you have proof that your absence from work was due to a valid reason and you had informed your employer about it. The resolution's Article 7, titled 'Cancellation of Unexpected Work Abandonment Report,' outlines circumstances under which MOHRE may cancel a UWA report at the employer's or employee's request.
